What are section 106 planning conditions?
S106 agreements are attached to the land, binding it and whoever owns it. Also referred to as planning obligations, S106 agreements may provide for financial contributions to be made by the developer to compensate for any loss or damage caused by the development, or to mitigate a development's wider impact.
Follow this link to the Talacre Facts website to find out more about the development at 52 Prince of Wales Road/Dalby Street NW5, where some of Talacre open space and a public road were lost due to development of the 7 storey apartment block known as Princes Park NW5 or Princes Court NW5.
It was partly this development and associated planning applications that spurred on the formation of the Friends and their work to get the open space registered as a Town Green and protect the open space from further loss due to development.
One of the Friends members has been campaigning for over a decade to find why Section 106 planning obligations that were breached by the developer and owners have not been successfully pursued by the London Borough of Camden.
Overage money of an estimated 7 figure sum is owed, and a traffic marshalling system should be in in place for safe vehicle use and pedestrian crossing of the service road, and access to the sports centre, including for children and disabled drivers.
As at March 2025 Camden are still investigating the failed traffic marshalling system and refusing to answer FOI requests because of the ongoing investigation.
